Terms & Conditions

  1. This agreement is between you the undersigned (you, your company, your employees, business partners, associate members and agents),AND Amplify My Business ACN: 614 38S 910 or it’s nominee, employee, coach and any associated parties, and relates to your participation in our programs, courses and coaching. The Company will provide the coaching and consulting Sessions through the Coach.
  2. Program materials in this agreement include but is not limited to videos, checklists, cheat sheets, webinars, training sessions, conferences, speakers, online training, manuals, website(s), one on one coaching, mentoring sessions or consulting sessions, and any other training material and/or workshops provided by us. Referred to as ‘Program Materials’ throughout this agreement.
  3. The program materials you receive and have access to are confidential and proprietary. Our materials cannot be used, disclosed or duplicated. These materials are unpublished works and no unauthorised copying, adaption, distribution or displays are permitted without our written consent both during and after any program has completed.
  4. You understand that program materials are not to be relied upon as professional advice or other advice and are used by you at your own discretion.
  5. You agree to communicate honestly, be open to feedback and suggestions, and to be fully engage.
  6. You acknowledge and agrees that coaching is a comprehensive process that may explore different areasof his/her life but it is ultimately the Client’s decision how he/she incorporates coaching into each aspect of life. You are solely responsible for implementing the techniques discovered through coaching.
  7. You understand that You are solely responsible for creating your own results. You understand that failure to meet your goals (in whole or part) cannot be guaranteed and no warranties are given.
  8. You are aware that coaching/consulting is not counselling, psychotherapy, psychoanalysis or any other form of mental health care treatment or therapy, nor is it to be used as a substitute for professional advice by legal, medical, financial, business or other qualified professionals.
  9. No representations or warranties are made with respect to your results to be achieved or obtained by participating in any of the Amplify my Business programs, coaching and consulting. You bear the sole responsibility for the use and implementation of the program materials, session learning/ understanding. You agree to forever indemnify and hold harmless your Business Coach, Amplify my Business and any other providers of program materials. Client agrees that the Coach is not liable or responsible for any actions or inactions, or for any direct or indirect result of any services provided by the Coach.
  10. All Memberships are based on the payment option as mention.You agree and authorize us to debit your card/account. To pay us, the Company, the Fees as set out in this Agreement and invoiced.
  11. There are no cancellations, hold periods or refunds during this time of your consulting and coaching.
  12. Failure to make payments as agreed on your plan may result in the cancellation of your membership. This is at our discretion and will require full payment of the plan or as agreed by us on demand. Consistent failed payments would result in an additional 2% administration charge for every day.
  13. After completion of membership you agree to automatically renew your membership and continue on same basis as original program signed unless agreed otherwise in writing.
  14. After your completion of program have been completed, you can cancel your membership at any time with 30 days notice in writing. Any payments that fall due within the 30 day notice period will still be due and payable and your program will end 30 days from the date of your final payment. You will have full use of the resources until that date.

  16. Your membership at any level can be upgraded at any time. Downgrading is not available.
  17. All changes, notices and agreements must be notified and agreed in writing by email or letter. SMS and verbal notices will not be recognized.
  18. Your membership will commence at the time your first payment is processed and continue as per the Amplify my Business Application Form regardless of your signature being applied to the Form for either membership or credit card authority. Payment will be processed as per this written signed agreement.
  19. We reserve the right to cancel your membership at any time should we deem it necessary.
  20. In the event of a dispute arising out of this Agreement that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys’ fees.
  21. You understand that we will/may be filming, recording, and photographing at our events. You hereby consent and agree that we or our agents have the right to take photographs, video, or digital recordings of you. You hereby release us, our agents and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. You waive any rights, claims or interest you may have to control the use in whatever media used. You understand that there will be no financial or other remuneration for recording you, either for initial or subsequent transmission or playback.
  22. Recording of any kind is not permitted during any of our events or sessions without our prior consent.
  23. From time to time your Business Coach (if applicable) will be required to attend educational workshops or take sick leave or a vacation and will need to reschedule sessions around such times.
  24. All sessions are up to one hour and are conducted by Phone or other online medium unless otherwise agreed. They may be moved or integrated across the entire membership period and are not necessarily held on a month by month or week by week basis.
  25. You are responsible for ensuring you keep your sessions. Where you do not attend a session you may forfeit it unless otherwise agreed with Coach. If You are late for a Session, the Session will complete at the scheduled time. You require to give 48 notice in advance if you require to reschedule your sessions.
  26. We may from time to time alter the program materials and/or the structure and pricing of your Membership program. Pricing changes will only be affected on a continuing or new agreement.
  27. This agreement is the entire agreement. All prior agreements, promises or representations are merged herein. Any changes must be in writing and agreed by all parties. This Agreement is legal and binding between the Parties as stated above.
  28. This agreement shall be governed by, construed and interpreted in accordance with the laws of the Country, State or Territory it is originated by us i.e Victoria.
  29. If any laws impose a change to the nature of any goods, services, consumption, value added or similar tax your payment amount will be adjusted to reflect and include these changes at the time they are imposed.
  30. Nothing in these Terms and Conditions is intended to have the effect of contracting out of any applicable provisions of the Competition and Consumer Act 2010 or the FTA in each of the States and Territories of Australia, except to the extent permitted by those Acts where applicable.
  31. This agreement is your tax record. Please ensure you use this to record details into your accounting system.
  32. Billing will be conducted by Amplify my Business or it’s nominee on behalf of the Business entity.
  33. You confirm you are authorised to sign this agreement for and on behalf of your business and agree to accept full responsibility for the Terms and Conditions both personally and on behalf of your business.
  34. Should your business be unable to comply for whatever reason you agree you will be personally liable and make payments as required.
  35. By online signing a Amplify My Business Application Form, and agreeing to the T&Cs of while buying the program, you agree to all of the T&Cs as stated herein.
